Gospel or Inspirational Song Contest Rules

1. NO PLEDGE OR DONATION NECESSARY TO ENTER OR TO WIN. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

2. TO ENTER AND PLAY: There is one (1) way to enter the Gospel or Inspirational Song Contest (the “Contest”): by creating an original gospel or inspiration song that meets the following criteria: song must be a) an original song composed by a high school student in a Prince George’s County Public School; b) of any length not exceeding three (3) minutes; c) must have a verse, chorus and bridge; d) may be of any tempo; e) may be created using any electronic device and software; f) must be submitted in MP3 or MP4 format; g) song lyrics must be submitted as a .pdf file with the song submission; and h) all songs must be submitted via email to info@4caapa.org with the subject line Gospel Song by March 26, 2021. All entries (“Song Submissions”) must be received by 11:59 p.m. (E.S.T.) on March 26, 2021 (the "Contest Deadline"). One (1) entry per person. WETA does not guarantee that duplicate entries will be invalidated. WETA will not be responsible for incomplete, illegible, lost, late, or misdirected Song Submissions or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or sponsor. In the event of a dispute, all email or electronic entries will be deemed to have been submitted by the owner of the email account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account. Any questions regarding the number of entries submitted or the owner of an email account shall be determined by WETA and CAAPA in their sole, reasonable discretion. WETA and CAAPA reserve the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest.

3. ELIGIBILITY: The Contest is open only to high school students in a Prince George’s County Public School who are residents of the 50 United States or the District of Columbia, and who have the consent of a parent or guardian to participate. Contest is not open to employees or interns of the Greater Washington Educational Telecommunications Association, Inc. ("WETA") or the Coalition for African Americans in the Performing Arts (“CAAPA”) and each organization's respective affiliates and subsidiaries, and the immediate family members of, and any persons domiciled with, such employees or interns.

4. PRIZES: Three (3) Contest winners will be selected in each of two (2) categories (Instrumental and Vocal) for a total of six (6) Contest winners. All six (6) Contest winners will be selected on or about April 16, 2021 by a panel of judges convened by CAAPA and WETA. One first prize winner in each category will receive a $100 gift card (approximate retail value: $0). One second prize winner in each category will receive a $75 gift card (approximate retail value: $0). One third place winner in each category will receive a $50 gift card (approximate retail value: $0). The approximate retail value of the prizes represents WETA’s and CAAPA’s good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prizes turns out to be less than the stated approximate retail value, the difference will not be awarded in cash.

5. ODDS: Odds of winning depend on the number of eligible entries received.

6. WINNER NOTIFICATION AND ACCEPTANCE: The winners will be notified by email or telephone on or about April 16, 2021. Inability to reach prize winners after reasonable efforts (as determined solely by CAAPA and WETA) may result in disqualification and an alternate winner may be selected. The winner may waive his or her right to receive a prize. Prizes are nonassignable and nontransferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and WETA and CAAPA reserve the right to substitute prizes of equal or greater value. The winner is solely responsible for reporting and payment of any taxes on prizes. The winner may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within 14 days of date of postmark. Failure to sign and return the affidavit or release within 14 days, or to comply with any term or condition of these Official Rules, may, at the sole discretion of WETA and CAAPA, result in a winner's disqualification, the forfeiture of winner’s interest in the prize, and the award of prize to an alternate winner. Except where prohibited, participation in the Contest constitutes entrant's parent or guardian’s consent to the publication of his or her name and image in any media for any commercial or promotional purpose, without limitation or further compensation.

7. PARTICIPATION: Participation in the Contest constitutes an agreement by each entrant to comply with these Official Contest Rules. By entering, participants further agree to be bound by the terms relating to the use of WETA's websites and CAAPA’s website, respectively, including their respective privacy policies. WETA and CAAPA reserve the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by WETA or CAAPA. In the event the Contest is compromised by malware, non-authorized human intervention, tampering or other any other cause beyond the reasonable control of WETA or CAAPA which corrupts or impairs the administration, security, fairness or proper operation of the Contest, WETA and CAAPA reserve the right in their sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, WETA and CAAPA reserve the right to award prizes based on the entries received before the termination date. Winners of the Contest are ineligible to win any other WETA Contest or Giveaway for a period of three (3) months from the expiration of the Contest Period.

8. INTELLECTUAL PROPERTY RIGHTS: Contest entrants will retain all intellectual property rights in their Song Submission. By entering the Contest, entrants grant to WETA and to CAAPA a perpetual license to duplicate, distribute, use, display, or otherwise exploit entrant’s Song Submission in any media, worldwide.

9. LIMITATIONS OF LIABILITY: By entering the Contest, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney's fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

10. CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Contest Rules, or the rights and obligations of any entrant and WETA or CAAPA, shall be governed by, and construed in accordance with the laws of the Commonwealth of Virginia, without giving effect to any choice of law or conflict of law rules or provisions (whether of Virginia, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Virginia. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

11. GENERAL RELEASE: By entering the Contest, entrants release WETA, CAAPA, any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).

12. SPONSOR: The Contest is sponsored by WETA and CAAPA, whose decisions regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. WETA and CAAPA will not be responsible for typographical, printing or other inadvertent errors in these Official Contest Rules or in other materials relating to the Contest.
